1. Agreement to Terms
By accessing or using the Lorevik platform at lorevik.com (the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Platform.
“Lorevik”, “we”, “us”, and “our” refer to [Lorevik Pty Ltd (proposed), ACN [●], ABN [●]].
The English version of these Terms controls to the extent permitted by law. Any translation is provided for convenience only and does not limit any mandatory rights available under applicable law.
2. Platform Description
Lorevik is a local-first Living Surface platform and marketplace. It lets creators package useful dashboards, routines, and agent-facing interfaces that users can install, run, exchange, and buy. Installing or browsing a listing alone does not upload raw owner data. Data may be processed or transmitted when a user enables or initiates an upload, publication, export, connector, AI provider, agent, or another permissioned feature.
3. Eligibility
To use the Platform, you must:
- Be at least 16 years of age
- Have the legal capacity to enter into a binding agreement
- Not have been previously suspended or removed from the Platform
4. User Accounts
4.1 Registration
You must register for an account to access certain features of the Platform. You agree to provide accurate, current, and complete information during registration.
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorised use
To the maximum extent permitted by law, Lorevik is not responsible for loss caused by your failure to take reasonable steps to protect your credentials or promptly report known unauthorised use. Nothing in this paragraph excludes responsibility that cannot lawfully be excluded.
5. Content and Intellectual Property
5.1 Creator Content
Creators retain any intellectual property rights they hold in the content and workflow materials they publish on the Platform. By publishing content, creators grant Lorevik a non-exclusive, worldwide, royalty-free licence to host, display, distribute, and promote the content on and through the Platform for the purpose of operating and marketing the service.
5.2 Living Surface and Local Vault Boundary
Lorevik may display Living Surface listings, package metadata, manifests, previews, consent state, and reviewed excerpts. Raw local vault files, private notes, credentials, and unreviewed source materials are not automatically uploaded merely because you install or browse a listing. Data may be processed or transmitted when you enable or initiate an upload, publication, export, connector, AI provider, agent, or another permissioned feature. The data path depends on the feature you enable and the permissions you grant.
Any specific licence terms concerning modification, derivative works, commercial use, workplace sharing, installation-package sharing, or device limits must be stated in the applicable listing or a separately published licence schedule. Those details are not defined in these Terms.
5.3 User-Generated Content
Any reviews, comments, or other content you submit to the Platform must not:
- Infringe any third party's intellectual property rights
- Contain defamatory, obscene, or offensive material
- Violate any applicable law or regulation
We may remove a listing or stop new sales of content that violates these Terms. Any effect on existing purchasers is governed only by Section 5.5.
5.4 Hosted Content and Copyright Complaints
Lorevik may remove or restrict access to hosted listings, previews, comments, or marketplace bundles where required by applicable law, a regulator, or a binding legal process. Lorevik may also pause new distribution while it reasonably reviews a substantiated copyright or other rights complaint. Removing hosted marketplace material does not by itself terminate an existing purchaser licence or disable an installed local copy.
A rights holder may submit a copyright complaint to support@lorevik.com. The complaint should identify the protected work, identify the affected listing or version, explain the complainant's rights and the basis of the complaint, provide contact details and supporting material, and confirm that the complaint is made in good faith. We may ask the creator to respond and may request further information before deciding what action is proportionate, unless law or urgent risk requires earlier action.
5.5 Marketplace Removal and Emergency Containment
Normal Removal
Where content is unpublished or removed from sale in the ordinary course, including at a creator's request or for a non-emergency policy issue, it will no longer be available for new purchases. Normal removal does not by itself terminate existing purchasers' licences, revoke their existing access rights, or disable installed copies.
Extreme Removal
Only where we reasonably determine that content contains malicious code, has a serious security vulnerability, is subject to a binding legal order, or infringes rights after the infringement has been confirmed, we may take proportionate emergency action. That action may include quarantining the affected listing or bundle, stopping further distribution, and, only where reasonably necessary, restricting access to or operation of affected purchased copies. This is not a general right to disable purchased content at any time.
We will use reasonable efforts to notify affected creators and purchasers and explain the action, unless notice is prohibited by law or immediate action is reasonably necessary to contain material harm. Any mandatory refund, replacement, cancellation, or compensation rights remain unaffected.
5.6 Platform Content
All Platform branding, design, software, and non-user content is owned by Lorevik and protected by applicable intellectual property laws. You may not copy, modify, or distribute any Platform content without our prior written consent.
6. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose
- Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
- Infringe on the intellectual property rights of others
- Attempt to gain unauthorised access to the Platform or other users' accounts
- Interfere with or disrupt the Platform's operation
- Use automated systems (bots, scrapers) to access the Platform without permission
- Impersonate any person or entity
7. Purchases and Payments
7.1 Pricing
All prices are displayed in the currency specified on the Platform. Prices are set by creators and may change at any time. The price at the time of purchase applies.
7.2 Payment Processing
For a creator product, the creator is the merchant and legal seller of record. Your payment is processed as a direct charge on that creator's connected Stripe account, and Lorevik receives a platform application fee from the creator. Lorevik is the seller only where a checkout clearly identifies a product as sold by Lorevik itself. By making a purchase, you agree to Stripe's applicable terms. We do not store your full payment card details on our servers.
Lorevik's standard platform application fee is currently 10% of the gross sale amount. Promotional rates may reduce that fee when disclosed to the Creator in the Creator Dashboard or applicable checkout terms.
7.3 Refund Policy
Lorevik provides a voluntary self-service refund option for digital content purchases under the following conditions:
- Self-service window: You may request a full refund through your order history within 2 hours of purchase
- After the self-service window: If the self-service option is no longer available, you may still contact us about any rights or remedies available in your circumstances
- Support: Contact us at support@lorevik.com with your order details
We reserve the right to deny requests under our voluntary refund policy that we reasonably believe to be abusive or fraudulent. The 2-hour refund window is Lorevik's voluntary refund policy and does not limit any rights available under applicable consumer protection laws.
Because the Creator is the legal seller of a Creator Product, the Creator remains primarily responsible for product support and remedies owed to the buyer under applicable law. Lorevik may receive and route a request or administer an authorised refund through Stripe. This role allocation does not exclude any responsibility that applicable law places on Lorevik.
7.4 Creator Payouts
Creator products use Stripe Connect direct charges: the buyer pays the creator as merchant of record, Stripe deducts Lorevik's platform application fee, and the remaining balance stays with the creator in their connected Stripe account. Creator pricing, platform fees, payout timing, and payment terms are governed by the relevant creator onboarding, checkout, dashboard, and the separate Creator Agreement.
7.5 Lorevik Creator Membership
Lorevik Creator Membership is a recurring subscription sold by Lorevik. The current plans are A$29 billed monthly and A$290 billed annually. The selected price and billing interval are shown before checkout, and the subscription automatically renews at that interval until cancelled.
You may cancel future renewals at any time through the Stripe-hosted billing portal available from your Lorevik account. The portal's confirmation explains how cancellation affects the subscription. A cancellation request stops future renewals in accordance with that confirmation; it does not create an absolute right to a refund for a current billing period and does not limit any rights available under applicable consumer protection laws.
Unless the checkout or billing portal states otherwise, or applicable law requires a different outcome, paid membership access continues to the end of the current paid billing period after cancellation. Access may end after that period if the subscription is cancelled or a renewal payment is not completed.
8. Disclaimer of Warranties
Nothing in these Terms excludes any guarantee, warranty, condition, remedy, or other right that cannot lawfully be excluded. Subject to those rights, the Platform and creator content are provided on an “as is” and “as available” basis, and Lorevik does not promise that every feature or item of creator content will be uninterrupted, error-free, accurate, or suitable for every purpose.

- Optional integrations may depend on third-party services
- Availability may be affected by maintenance or security action
Content published by creators represents their views and expertise. Lorevik does not endorse, verify, or guarantee the accuracy of creator content.
Lorevik content and workflow tools are not professional legal, financial, medical, tax, migration, or accounting advice unless expressly provided by a qualified professional under separate terms.
9. Limitation of Liability
To the maximum extent permitted by Australian law:
- In no event shall Lorevik be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.
10. Indemnification
To the maximum extent permitted by law, you are responsible for reasonable losses and third-party claims to the extent they are caused by your unlawful content, your wilful misconduct, or your material breach of these Terms. This responsibility does not apply to the extent a loss is caused by Lorevik's breach, negligence, or unlawful conduct, and it does not limit mandatory consumer rights.
- Content you submit without the required rights or permissions
- Fraud, abuse, or unlawful activity conducted through your account
- A material breach that causes a substantiated third-party claim
11. Termination
11.1 By You
You may close your account at any time by contacting us or using the account settings feature.
11.2 By Us
We may suspend or terminate your account at any time if:
- You breach these Terms
- We are required to do so by law
- We reasonably believe your account poses a security risk
- Your account has been inactive for an extended period
11.3 Effect of Termination
Upon termination:
- Your account may no longer access general account and publishing features
- Account termination does not by itself terminate licences you already acquired, remove ordinary existing purchase access, or disable installed copies. Any exceptional restriction of purchased content is limited to Section 5.5
- Provisions that by their nature should survive termination will remain in effect (including intellectual property, limitation of liability, and indemnification)
12. Dispute Resolution
We encourage you to contact us first to resolve any dispute informally. The parties may agree to mediation, but mediation is not a mandatory precondition to exercising a statutory right, contacting a regulator, seeking urgent relief, or bringing a claim in a court or tribunal that has jurisdiction.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Each party submits to the non-exclusive jurisdiction of the courts and tribunals of New South Wales. Nothing in this clause limits a mandatory consumer right or prevents a person from bringing a claim in another forum available under applicable law.
14. General Provisions
- Entire agreement: These Terms constitute the entire agreement between you and Lorevik regarding the Platform
- Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force
- Waiver: Failure to enforce any provision does not constitute a waiver of that provision
- Assignment: You may not assign your rights under these Terms without our written consent, which will not be unreasonably withheld. We may assign these Terms to an affiliate or in connection with a genuine merger, reorganisation, financing, or sale of all or substantially all of the relevant business, provided the assignment does not reduce mandatory rights
15. Changes to These Terms
We may update these Terms prospectively where reasonably necessary to reflect changes to the Platform, law, security requirements, or our business. We will explain material changes and give reasonable advance notice through the Platform or email. A change will not retrospectively reduce an existing purchaser licence or a mandatory right. Where law requires fresh agreement, we will ask you to accept the updated Terms; otherwise, you may stop using the affected future service before the change takes effect.
